When a person files a civil suit against a defendant, the court may award a judgment in favor of the former, which makes the latter a judgment debtor. However, this is only on paper. After this, the court is no longer involved and the enforcement is left to the creditor. The involved parties can discuss the same over a period but there is a good chance that the creditor does not get his dues. In fact, 80% such cases do not get the due payment made. Hiring an attorney for the same will eat into the outstanding amount leaving little after recovery, so the people also sit tight. They do not know what steps to take if the debtor moves, hides his assets, and takes on a different name to avoid payment. Most people are ignorant of the measures available against the absconders -

  • Recovery through public sales-The plaintiff can approach the court with a list of the defendant’s personal property. An order may be issued for a court officer to seize the same and sell it to make the necessary payments. A petition can also be filed with the court with a list of items that is owed, the court then orders that the required assets be discovered, and debts settled. 
  • Recovery through wage garnishment-Once the creditor identifies the debtor’s place of employment, he can approach the court who will ensure that payment is made by securing the salary, income tax refunds and the like. Sending a notice of wage execution to the employer who will then withhold the necessary amount and remit the same to the court does this.
  • Recovery through seizure of bank assets-Here the creditor has to identify the place where the debtor’s savings account is located. On informing the court, these accounts are frozen and the funds are released to the former. If he cannot find the accounts then a subpoena can be obtained from the court questioning the debtor’s assets and delivered to the debtor.
  • A creditor is also entitled to interest on the outstanding amount until full payment is made. The state legislature or the state’s department of treasury fixes this rate of interest.

Today judgment recovery is burgeoning into a business as recovering outstanding claims from lawsuits allows one to keep a cut from the recovered amount. Though there are no licensing needs, some states have decreed that such claims be bought or recovery made through a licensed collecting agency. This work is difficult and more suited to a practicing private detective as it involves determining whether money is hidden in offshore accounts or obtaining proof of transfer of possessions to near relatives. Today there are judgment recovery lessons offered on the Internet as well in the cost range of $100 to $200.
